1. Policy Scope

This Policy applies to the Personal Information we collect and use for our own purposes as a "data controller". It applies to individuals who:

  • Visit or interact with our Websites, including www.aneeverse.com ("Website Visitors");
  • Subscribe to any of our services or plans ("Subscribers" or "Users"); and
  • Attend or register for events organized or co-organized by Aneeverse ("Attendees").

In providing our Services, we may also process certain Personal Information on behalf of our Subscribers as a "data processor". In such cases, Subscribers act as data controllers and are solely responsible for establishing privacy practices and ensuring compliance with applicable laws in respect of that data.

2. Personal Information You Provide

"Personal Information" means any information relating to an identified or identifiable natural person.

Account and Registration Information. If you are a Subscriber, we process Personal Information such as your first name, last name, IP address, email address, phone number, and, if applicable, payment information (collectively "Account Information") to provide our Services. By voluntarily providing this information, you represent that you are the owner of such Personal Information or are otherwise authorized to provide it to us.

User Information. We collect certain information automatically from Users through cookies and other tracking technologies when they use our Services, subject to applicable consent requirements. We use this information to improve our Services and user experience.

Communications. If you contact us by email, telephone, or correspondence, we may collect such information into a file specific to you for the purpose of responding to your inquiry and improving our Services.

Log Files. As is typical for most websites, we gather certain information and store it in log files when you interact with our Websites. This includes internet protocol (IP) addresses, browser type, internet service provider, URLs of referring/exit pages, operating system, date/time stamp, and system configuration information.

Tracking Technologies. We and our authorized processors use cookies and other information-gathering technologies for a variety of purposes. Session Replay. We may use session replay scripts provided by third-party analytics providers to better understand user needs and optimize our Services. These tools may record clicks, mouse movements, scrolling, and form interactions on our Websites. We do not record sensitive information, and recordings are kept for a maximum of thirty (30) days.

Do Not Track. Since Aneeverse does not track Users over time and across third-party websites for targeted advertising, we do not respond to Do Not Track (DNT) signals.

Health Information. Aneeverse is not a HIPAA Business Associate and should not be used to store any protected health information ("PHI"). Uploading or storing PHI constitutes a violation of our Terms of Use.

4. Personal Information We Collect From Other Sources

Social Media Widgets. Our Websites may include social media features such as Facebook, LinkedIn, or Instagram buttons. These may collect your IP address and which page you are visiting, and may set a cookie to enable the feature to function properly. Your interactions with these features are governed by the privacy policy of the companies that provide them.

Third-Party Services. We may obtain Personal Information from third parties and combine it with information we collect through our Websites. For example, if you log into our Services through a third-party authentication service, you authorize us to process the Personal Information that the service makes available to us in accordance with this Policy.

Aneeverse processes your Personal Information in compliance with the Digital Personal Data Protection Act, 2023 ("DPDP Act") of India, as well as any rules and regulations notified thereunder. The DPDP Act establishes the rights of individuals ("Data Principals") regarding their personal data and the obligations of entities processing such data ("Data Fiduciaries").

Our lawful basis for processing your Personal Information includes:

  • Consent - where you have given free, specific, informed, unconditional, and unambiguous consent for processing your Personal Data for a specified purpose;
  • Contract - where processing is necessary for the performance of a contract to which you are a party, or for taking pre-contractual steps at your request;
  • Legitimate Uses - where processing is necessary for employment-related purposes, for providing subsidies, benefits, or services by the State, or for other purposes specified under the DPDP Act or any applicable rules; and
  • Legal Obligation - where processing is necessary for compliance with applicable Indian law.

For individuals located in the European Economic Area, United Kingdom, or Switzerland, we additionally rely on the General Data Protection Regulation (GDPR) legal bases, including legitimate interests, performance of a contract, and explicit consent where required.

7. Why We Share Your Personal Information

We take care to allow your Personal Information to be accessed only by those who need it to perform their duties. We may share Personal Information with:

Third-Party Service Providers. We share Personal Information with service providers for hosting, application development, backup, storage, payment processing, analytics, and other services. We do not permit our service providers to use your Personal Information for their own marketing purposes.

We will retain Personal Information we collect from you where we have a justifiable business need to do so, or for as long as is needed to fulfill the purposes outlined in this Policy, unless a longer retention period is required or permitted by applicable Indian law or other applicable law (such as for tax, legal, or accounting purposes).

When we have no justifiable business need to process your Personal Information, we will either delete or anonymize it. If deletion is not immediately possible (for example, because your Personal Information has been stored in backup archives), we will securely store your Personal Information and isolate it from any further processing until deletion is possible.

12. Consent to International Transfer of Personal Information

Your Personal Information and files are stored on our servers. Your information may be transferred to servers and databases located outside of your state, province, country, or other governmental jurisdiction, where the privacy laws may not be as protective as those in your jurisdiction.

Under the DPDP Act 2023 and other applicable laws, you may also have the right to:

  • Access the Personal Information we hold about you and obtain a summary of the processing activities;
  • Correct inaccurate or incomplete Personal Information;
  • Erase your Personal Information in certain circumstances (see Section 14);
  • Withdraw consent at any time for processing based on consent, without affecting the lawfulness of prior processing;
  • Nominate another individual to exercise your rights on your behalf in the event of your death or incapacity; and
  • Lodge a complaint with the Data Protection Board of India (once constituted under the DPDP Act) or any other applicable data protection authority.

14. Right to be Forgotten (Right of Erasure)

If you no longer wish to use our Services, you may request an erasure of your Personal Information by writing to us at legal@aneeverse.com. We will erase your Personal Information and notify you when the erasure is completed. However, we will balance your right to be erased against any public interest in the availability of the data, and against our legal obligations to retain certain data under applicable Indian law. Some information may be retained in anonymized form for analytical or statutory purposes.

15. Right to Object or Opt-Out

You may object to our processing of your Personal Information for direct marketing purposes at any time. If you choose to object, we will cease processing your information for direct marketing purposes, unless there are compelling legitimate grounds for the processing that override your interests. Please note that as a result of such an objection, you may not be able to use the full functionality of our Services.

16. Business Transitions

In the event that Aneeverse undergoes a business transition, such as a merger, acquisition by another company, or sale of a portion of its assets, your Personal Information will, in most instances, be part of the assets transferred. You will be notified via a prominent notice on our Website thirty (30) days prior to any change of ownership or control of your Personal Information, so that you may take appropriate action, including requesting erasure of your information prior to such transfer.

17. Notice to California Residents (CCPA/CPRA)

This notice is provided under California law, including the California Consumer Privacy Act ("CCPA") as amended by the California Privacy Rights Act of 2020 ("CPRA"). If you are a California resident, this Section applies to you in addition to the rest of this Policy.

We do not sell users' Personal Information as the term "sell" is commonly understood. In the preceding 12 months, we have collected the following categories of Personal Information: identifiers, commercial information, internet or electronic network activity information, and inferences. California residents have the right to: opt out of the sale or sharing of Personal Information; correct inaccurate Personal Information; request deletion of their Personal Information; and access and portability of their Personal Information.

18. Other U.S. State Privacy Acts

This section applies to residents of Colorado, Connecticut, Utah, and Virginia under their respective state privacy regulations. You may have the right to access or port your Personal Information, request deletion of your Personal Information, opt-out of targeted advertising, and correct inaccuracies in your Personal Information. 19. Children's Personal Information

We do not knowingly collect any Personal Information from children under the age of 18. If you are under 18, please do not use or submit any Personal Information through our Websites or Services. We encourage parents and legal guardians to monitor their children's internet usage and to help enforce this Policy. If you have reason to believe that a child under 18 has provided Personal Information to us, please contact us at legal@aneeverse.com, and we will use commercially reasonable efforts to delete that information in compliance with applicable law.

Our Website may contain links to other websites. Please be aware that we are not responsible for the privacy practices of such other websites. We encourage you to be aware when you leave our Website and to read the privacy statements of each website that collects personally identifiable information from you. 21. Legal Disclaimer

Though we make every effort to preserve users' privacy, we may need to disclose your Personal Information when required by applicable Indian law, or when we have a good-faith belief that such action is necessary to comply with a current or pending judicial proceeding, a court order, or an investigation of unlawful activity or activity that may expose us or you to legal liability.

We reserve the right to amend or modify this Privacy Policy from time to time. Such modifications shall be effective immediately upon posting of the modified Policy on our Website. You are responsible for regularly reviewing information posted online to obtain timely notice of such changes. Your continued use of our Website after amendments are posted constitutes your acceptance of this Policy as modified. If we make substantive changes to this Policy, we will announce it prominently on our Website.
